موجز الأحداث

What happened in Brief

I am Dr. Engineer Raafat Osman working in the United Arab Emirates and I own a general contracting company in the country since 36 years. In 1994 my money and company were illegally taken forcibly by the UAE national; Humaid Al Shaibah in collaboration with and support of Ajaman Municipality. He was also supported by the official authorities in the country such as the police , public prosecution and the ministry of justice which committed gross crimes such as falsifying official papers , threatening the judges ,revoking judgments on holidays , withdrawing the cases from the court and preventing me to file these cases before the courts , as follows ;

مقدمه الدكتور مهندس/ محمد رأفت أحمد عثمان واسم الشهرة "رأفت عثمان" ـ أعمل مقاولا بدولة الامارات العربية وأمتلك شركة مقاولات عامة بالدولة من 36 عاما، وفي عام 1994 تم الاستيلاء دون سند من القانون علي أموالي وشركتى بالقوة من قبل المواطن الاماراتى حميد الشيبة بمشاركة ودعم بلدية عجمان ومساندة اجهزة الدولة الرسمية من الشرطة والنيابة العامة ووزارة العدل التى اقترفت جرائم مؤثمة بالقانون الجنائي المحلي والدولي.. كالتزوير بالأوراق الرسمية وتهديد القضاة والغاء الاحكام بايام العطلة وسحب القضايا من المحكمة ومنعى من اقامتها امام القضاء.. وذلك علي النحو التالي:

Police participation of thieves

In 1994 the UAE national Humaid Al Shaibah took in collaboration with and support of Ajman Municipality, my company and money and the municipality issued building license in the name of another contractor and they put a signboard on my properties. I hurried up and lodged a complaint to Ajman Police informing them that my properties were stolen. The Police refused to accept the complaint. I informed the Attorney General with the same. The Police Director General hide the complaint and it did not appear save I could reach HH Late Sheikh Zayed by the end of 1998. He removed the Police Director General Abdullah Hamad Al Shamsi. Just then inquiries started at the prosecution and it passed its decision to enroll the case 2205/2000 as a theft crime against my opponents and to keep the same because three years elapsed which the period during which the police hid my complaint. This means that the police participated and helped my opponents to take my moneys and protected them against punishment.

عام 1994 استولي المواطن الاماراتى حميد الشيبة بمشاركة ودعم بلدية عجمان بالقوة علي شركتى واموالي واصدرت البلدية ترخيص بناء باسم مقاول اخر ووضعت لافتته علي ممتلكاتى، فاسرعت بتقديم بلاغ بسرقة ممتلكاتى لشرطة عجمان لكنها رفضت فتح بلاغى بالسرقة فتقدمت للنائب العام بابوظبي بالبلاغ وبعد تحرك البلاغ لعجمان قام مدير عام الشرطة باخفاؤه ولم يظهر الا بعد وصولي للشيخ زايد بنهاية عام 1998 وتدخله وعزل مدير عام الشرطة عبد الله حمد الشمسى وعليه تمت التحقيقات بالنيابة وصدر قرارها بقيد القضية 2205/2000 جريمة سرقة ضد خصومى وحفظها لمضى المدة لمرور 3 سنوات علي الجريمة وهي المدة التى اخفت فيها الشرطة بلاغى، اي ان اجهزة الدولة من الشرطة هي التى شاركت وساعدت الخصوم علي الاستيلاء علي اموالي وحماية الخصوم من توقيع العقوبة عليهم

Eliminating provisions secretly in holidays

In 1996 during the criminal dispute a precautionary attachment was passed in my favour in one of the cases related to my rights (6/96) Plenary Ajman which I filed to refund Dhs. 3,500,000. After some days of passing this judgment and starting the procedures of the attachment at the banks and on the real estates , Ajman Court revokes the judgment on a holiday and through an incompetent staff and without my knowledge . Accordingly, Mr. El Sayed El Shiwy, the President of the competent court resigned. He is now a judge at the Court of Appeal in Egypt. I submitted complaints to the minister of justice, but in vain and he did not take any step and make any inquiries about the incident!!

عام 1996 واثناء النزاع الجنائي صدر حكم حجز تحفظى لصالحى باحد القضايا الحقوقية رقم 6/96 كلي عجمان المقامة منى لاسترداد حقوقي بمبلغ 3,5 مليون درهم ، وبعد صدوره بايام وبدء اجراءات الحجز بالبنوك وعلي العقارات قامت اجهزة الدولة ممثلة في محكمة عجمان بالغاء الحكم بيوم عطلة وبهيئة غير مختصة ودون علمى وعليه تقدم المستشار السيد الشيوى رئيس المحكمة المختصة بالاستقالة وهو حاليا قاضيا بالاستئناف بمصر وتقدمت بالشكاوى لوزير العدل دون جدوى ولم يتخذ اي اجراء ولا تحقيقات بالواقعة!!

تعطيل القضاء وافشاء شريعة الغاب

In operation of justice and spreading forest law

In 2000 I filed a compensation case against Ajman municipality which is a governmental authority because it acted in collusion with my opponents to take my moneys. The public intervention took place and an official order was issued by Ajman Ruler to withdraw the case from the court and to prevent me from claiming my rights through the courts. I was announced officially with the same by Ajman Ruler Court and this was kept at the Ruler's Court. This incident proves clearly despoil my constitutional right and preventing me to claim my rights via the courts in UAE the matter that opens the field to give chance to another country for litigation competence.

عام 2000 اقمت قضية تعويض ضد بلدية عجمان وهي جهه حكومية لتواطئها مع الخصوم في الاستيلاء علي اموالي وحدث التدخل العلنى بالقضاء وصدر امر رسمى من حاكم عجمان بسحب القضية من المحكمة ومنعى من المطالبة بحقوقي بالقضاء وتم اعلانى رسميا بذلك من ديوان حاكم عجمان وحفظت بديوان الحاكم وهذه الواقعة تثبت بجلاء سلب حقي الدستورى ومنعى من المطالبة بحقوقي عبر القضاء بدولة الامارات مما يفتح المجال لانعقاد اختصاص التقاضى باي دولة اخرى

تزوير النيابة العامة لأبوظبي للقضايا

Forgery by Abu Dhabi public prosecution

The official authorities in UAE represented in Abu Dhabi Prosecution Public forged the official papers 10 repeated times to trump me up wrongly and it forged 10 hearing minutes to prevent me to continue my claim . This was known and I filed against them the Criminal case No. 2343/2000. Up till now the forgers have not been punished.

قامت الاجهزة الرسمية للدولة ممثلة في النيابة العامة لابوظبي بالتزوير بالاوراق الرسمية 10 مرات متكررة لتلفيق تهمة لي بالباطل حيث زورت 10 محاضر جلسات احد القضايا لتلفيق تهمة لي لمنعى من الاستمرار في المطالبة بحقوقي وتم افتضاح امرها واقمت ضدهم القضية الجنائية رقم 2343/2000 ولم توقع العقوبة علي المزورين للان

Threatening the judges

The official authorities in UAR represent in the Undersecretary of the ministry of justice who threatened the judges not to pass any executive judgment in my favour. The same was done with the arbitrator of the ministry of justice and it was clear that he was threatened by the same undersecretary.

قامت الاجهزة الرسمية للدولة ممثلة في وكيل وزارة العدل بتهديد القضاة لعدم اصدار اي حكم تنفيذى لصالحى وكما حدث في تهديده لمحكم وزارة العدل وتم اتحقيق الرسمى بالواقعة وتبين تهديده من قبل وكيل وزارة العدل

الأمر السامي لسمو الشيخ زايد آل نهيان رئيس الدولة

FROM Highness Sheikh Zayed Al-Nahya

In 2002, I conveyed my complaint to Sheikha Fatima, spouse of HH Sheikh Zayed the President of UAE at that time and after consideration she sent a letter with all the supporting documents on 31.12.2002 to Sheikh Mansour, Manager of the President Office. In this letter:

A. Proved some serious incidents of the power centers such as taking my moneys by force and hiding the complaints I submitted and canceling a judgment which was in my favour in 1996 at AED. 3,5 million

B. Proved that my dues according to the expertise report issued by the ministry of justice in 2000 were AED 38 million and the court of cassation approved the report but it passed its judgment to re file a new suit to obligate the opponents to pay my approved dues.

C. Proved that my only son, 12 years old, deceased and I have not able to bury him or visit his grave up till now.

D. Proved that I sustained angina and I am badly in need of open heart surgery outside UAE and I enclosed the medical report showing the same.

Due to the foregoing, Sheikh Zayed issued in 2004 his instructions to form a special court consisting of five judges to decide the cases and to refund my moneys through three months. After Late Sheikh Zayed had deceased, the minister of justice in person suspended the tasks of the special court several times in collusion with my opponents. Despite the formation of the special court to decide the dispute and refunding my moneys within three months from 21.11.2004 which is the date of the minister of justice to form the special court but up till now and we are in 2010 , the special court is unable to pass the judgment due to the pressures of the power centers at the official authorities in the country .

عام 2002 أوصلت شكواي للشيخة فاطمة حرم الشيخ زايد رئيس الدولة حينها وبعد دراستها أصدرت كتاب مرفق به كافـــة المستندات الثبوتية في31/12/2002 للشيخ منصور بن زايد مدير مكتب رئيس الدولة وثبت بهذا الكتاب:

أولا- اثبت بعض الوقائع الخطيرة لمراكز القوى بالدولة مثل الاستيلاء علي أموالي بالقوة وإخفاء البلاغات التى تقدمت بها ، وإلغاء حكم لصالحى عام 1996 بمبلغ 3,5 مليون درهم إماراتى.

ثانياـ أثبت أن حقوقي طبقا لتقرير خبرة وزارة العدل الصادر عام 2000 هى مبلغ 38 مليون درهم وان محكمة النقض اقرت التقرير وتقدير قيمة حقوقي لكنها حكمت باعادة رفع دعوى جديدة لالزام الخصوم بدفع ماثبت من حقوقي

ثالثاـ أثبت واقعة وفاة ابنى الوحيد بمصر عن 12 عاما ؛ واننى لم استطع مواراته الثرى أو زيارته بقبره حتى الآن.

رابعاـ أثبت واقعة إصابتى بالذبحة الصدرية واننى بحاجة لعمل عملية جراحية عاجلة للقلب المفتوح خارج الدولة وأننى أرفقت التقرير الطبي الدال علي ذلك.

علي ذلك اصدر الشيخ زايد رئيس الدولة في عام 2004 امرا بتشكيل محكمة خاصة من 5 قضاة للفصل بالقضايا واسترجاع اموالي خلال 3 شهور، وبعد وفاة الشيخ زايد أوقف وزير العدل شخصيا اعمال المحكمة الخاصة عدة مرات تواطؤا مع الخصوم ورغم تشكيل المحكمة الخاصة لانهاء النزاع واسترجاع اموالي خلال ثلاثة أشهر من تاريخ 21/11/2004 وهو تاريخ قرار وزير العدل بتشكيل المحكمة الخاصة ولكن للان ونحن بعام 2010 فلا تستطيع المحكمة الخاصة اصدار الحكم بسبب الضغوط الواقعة عليها من مراكز القوى بأجهزة الدولة الرسمية

Egyptian Embassy TO officials in UAE

In 2004 the Egyptian Ministry of Foreign Affairs addressed the UAE Embassy in Cairo and the concerned authorities in UAE and called HIM the Egyptian Ambassador Fahmi Fayed to do his utmost to finalize the dispute and to refund my moneys. In fact the Ambassador carried out may trials and issued official letters from the Egyptian Embassy and met senior officials at the presidency. He also met Sheikh Mansour Bin Zayed, the minister of the Presidency affairs. At last the Ambassador informed me that a settlement will be conducted and the Presidency Court will pay me. The Legal Advisors of the President called me and I handed them over all the supporting documents. After the Egyptian ambassador had finished his work and went back to Egypt, the Presidency Court did not abide to pay my dues according to their agreement with the Egyptian Ambassador.

كما قامت وزارة الخارجية المصرية عام 2004 بمخاطبة السفارة الاماراتية بالقاهرة والجهات المعنية في دولة الامارات وتكليف سعادة السفير المصرى فهمى فايد بعمل اقصى المحاولات لانهاء النزاع واسترجاع اموالي، وفعلا قام سعادة السفير مشكورا بمحاولات كثيرة واصدار الكتب الرسمية من السفارة المصرية ومقابلة كبار المسئولين بالرئاسة ومقابلة الشيخ منصور بن زايد وزير شئون الرئاسة.. وبالنهاية أبلغنى السفير بصدور قرارا بعمل تسوية وديوان الرئاسة سوف يدفع واستدعانى المستشارون القانونيون لرئيس الدولة وسلمتهم جميع المستندات الثبوتية... ولكن بعد انتهاء فترة عمل السفير المصري بابوظبي ورجوعه لمصر لم تلتزم رئاسة الدولة بدفع حقوقي طبقا لاتفاقها مع السفير المصري .

My dues were proved via the expert of the ministry of Justice Dr. Moustafa Momen, amounting to Dhs.38 million for the damages that inflicted me since 1994 up to 2000. But the official authorities pressed the court of cassation so as not to pass an obligatory judgment for paying. A judgment proving the damages was passed as a final judgment for a proof action for the damages and another case should be filed to obligate the opponents to pay my dues which were confirmed in the report. Actually I filed a new case and it was deliberated in the courts till it reached to the court of cassation. But it was withdrawn from the court of cassation in 2004 and was handed over to the special court formed by UAE President in 2004 so as to pass a judgment within three months. Up till now the judgment has not yet been passed due to the intervention of the power canters at the country official authorities.

تم اثبات حقوقي بتقرير خبير وزارة العدل الدكتور مصطفى مؤمن بمبلغ 38 مليون درهم عن الاضرار التى لحقتنى من عام 1994 الي عام 2000 ولكن الجهات الرسمية ضغطت علي محكمة النقض حتى لاتحكم بالالزام بالدفع، فصدر الحكم باثبات ماجاء بتقرير الخبرة من اضرار علي انه حكم نهائى لدعوى اثبات حالة الاضرار وانه يجب اقامة دعوى اخرى لالزام الخصوم بدفع حقوقي التى ثبتت بالتقرير.. وفعلا اقمت دعوى جديدة تم تداولها بالمحاكم حتى وصلت الي محكمة النقض.. لكن تم سحبها من محكمة النقض عام 2004 وتسليمها للمحكمة الخاصة التى شكلها رئيس الدولة عام 2004 للحكم خلال 3 شهور وللان لم تستطع الحكم بسبب تدخل مراكز القوى باجهزة الدولة الرسمية.

التماس لسمو رئيس دولة الامارات بمرفقاته 26/1/2010

Petition to HH the President of UAE annexes 26/01/2010

The special court ignored the Ministry of Justice expertise report issued in 2000 and attested by the Court of Cassation despite its determinative effect. My dues were Dhs. 38 million. In 2006 a tripartite panel was delegated from the Ministry of Justice so as to make another expertise report. After three years they submitted their report which was also in my favour and against my opponents at Dhs. 53 million. On 23.02.2009 the panel nullified it in form and not in subject for weak reasons and it became clear that the panel was unable to pass a judgment due to the pressures practiced thereon.

The panel erred and expressed its intensions regarding this judgment and provided that the case was not urgent!! Failing to remember that the reason of their appointment by the President of the Country was to expedite the judgment within three months from 2004!!

I submitted a petition to HH the President of UAE in this regard but the Power centers prevents this petition to reach to him!!

تجاهلت المحكمة الخاصة تقرير خبرة وزارة العدل الصادر عام 2000 والمصدق من محكمة النقض رغم حجيته وكان مقدرا حقوقي بمبلغ 38 مليون درهم... وانتدبت عام 2006 لجنة خبراء ثلاثية من وزارة العدل لعمل تقرير خبرة آخر وبعد 3 أعوام قدموا تقريرهم الذي كان أيضا لصالحي ومدينا لخصومي وقدر حقوقي بمبلغ 52 مليون درهم.. وبتاريخ 23/2/2009 قامت الهيئة ببطلانه شكليا وليس موضوعيا لاسباب واهية وتبين بجلاء انها غير قادرة علي الحكم بسبب الضغوط الواقعة عليها.

وقد اخطأت وافصحت عن نواياها في هذا الحكم ونصت فيه ان القضية ليس بها وجه استعجال !!

متجاهلين سبب تعينهم من رئيس الدولة كمحكمة خاصة وانه لسرعة الحكم بالقضية خلال 3 أشهر من عام 2004

ولقد تقدمت بالتماس لممثل سمو رئيس الدولة بخصوص ذلك لكن مراكز القوى تمنع وصوله اليه!!

صدور حكم المحكمة الخاصة الظالم بتطبيق شريعة الغاب بالامارات 2010

Special Court decides the application of the unjust law of the jungle in UAE 2010

Finally, on 13/04/2010 the court pronounced the unjust verdict to ignore all criminal cases against the state, such as counterfeiting official documents, and ignoring the law and the authority of the final civil and criminal provisions and all the reports of experience of the past years. Furthermore, it was issued in page 83 full blackout of truth and it was proved incorrect and inconsistent facts with the Constitution and the law and the final civil and criminal provisions. The court designed itself as a lawyer and an engineering expert to defend the opponents unjustly and hiding the bright truth. Moreover, it decided to apply the law of the jungle to take possession of the property of others without recourse to the judiciary. The court sentenced me only the amount of 820,000 Dhs. Although my rights were fixed by all the provisions and committees under the Special Court itself is 52 million dirham!! This confirms the law of the jungle and the approval of the takeover of foreigner businessmen's money by Emirate citizens. It is clear for any one who knows the law that the style and grounds of the verdict throughout the 83-pages have nothing to do with law and the verdict was imposed on the Special Court!!

وأخيرا في 13/4/2010 صدر الحكم الظالم الذي تجاهل جميع الوقائع الجنائية ضد الدولة مثل التزوير بالاوراق الرسمية وأهدر القانون وحجية الأحكام النهائية المدنية والجنائية وجميع تقارير الخبرة والسنوات الماضية بالقضاء!! بل وصدر في 83 صفحة كاملة للتعتيم واثبات وقائع غير صحيحة ومتعارضة مع الدستور والقانون والاحكام النهائية المدنية والجنائية!! ونصبت المحكمة نفسها محاميا وخبيرا هندسيا للدفاع عن الخصوم بالباطل وبالمخالفة للقانون طمساً للحقائق الساطعة بل واقرت شريعة الغاب في الاستيلاء علي ممتلكات الغير بالبلطجة دون الرجوع للقضاء وحكمت لي بمبلغ 820 الف درهم فقط رغم ان حقوقي الثابتة بجميع الاحكام ولجان الخبرات التى انتدبتها المحكمة الخاصة نفسها هي 52 مليون درهم!! وهذا يؤكد شريعة الغاب واقرار استيلاء المواطنيين الاماراتيين علي اموال الوافدين من رجال الأعمال!! وواضح لأي قانونى أن سياق وأسلوب وأسانيد وحجيات الحكم طوال 83 صفحة ليس له علاقة بلغة القضاة وكأنه حكماً مفروضاً علي المحكمة الخاصة!!

Documents, death of my son, ruining my family

My passport was kept by the court till settling the dispute and for postponing the charges of the cases I filed from the beginning of the dispute since 16 years and up till now. In addition to my claim to pay the remaining part of the equipment price which they stole from 1994. I cannot go to my country and I cannot see my family. My son deceased and I am suffering from angina and I supposed to have an open heart operation outside UAE since 2000 , And the state agencies still involved in the judiciary and thus the continued detention of my passport all these years!!

تم حجز جواز سفرى من قبل المحكمة لحين الفصل بالنزاع لتاجيل رسوم القضايا المقامة منى من بداية النزاع من 16 عاما وللان، اضافة لمطالبتى بدفع باقى ثمن المعدات التى سرقوها من عام 1994، وكل هذه الاعوام لا استطيع السفر لبلدى ولا رؤية اسرتى وابنى توفي عن 12 عاما بمصر عام 1996 ولم استطع دفنه ولا زيارته بقبره للان وتم اصابتى بالذبحة الصدرية عام 2000 ومفروض عمل عملية القلب المفتوح خارج الدولة من عام 2000، ولازالت اجهزة الدولة تتدخل بالقضاء وبالتالي استمرار حجز جواز سفرى كل هذه السنوات!!

This is a faint cry from a helpless person, who lost his money, his family, his son and his freedom, only because of the centers of power in UAE.

I submitted a petition to HH the President of UAE in this regard but the Power centers prevents this petition to reach to him!!

وقد اخطأت وافصحت عن نواياها في هذا الحكم ونصت فيه ان القضية ليس بها وجه استعجال !!

متجاهلين سبب تعينهم من رئيس الدولة كمحكمة خاصة وانه لسرعة الحكم بالقضية خلال 3 أشهر من عام 2004

ولقد تقدمت بالتماس لممثل سمو رئيس الدولة بخصوص ذلك لكن مراكز القوى تمنع وصوله اليه!!
